The draft policy is the sixth since the Licensing Act 2003 became law on 24th November 2005.

A number of revisions have been made by the Government in the light of experience of the Act and suggestions from its practitioners and the Policy has also been updated to reflect amendments to the Section 182 Guidance.

The policy is new to this council and has been specifically prepared to take account of the provisions of the Levelling Up and Regeneration Act 2024 which make the Pavement Licence provisions in The Business and Planning Act 2020 permanent.

The new legislation increases the duration of licences to 2 years and provides enforcement powers for local authorities

It also gives the Authority the ability to charge up to £500 for new applications and £350 for renewal applications, but these fees can only be charged on a cost recovery basis.

Any comments on the Policy should be received by the Licensing Team no later than 29 September 2024.

Re: Consultation – Proposed Amendments to Taxi Licensing Policy

Mid Sussex District Council is currently considering making amendments to our Hackney Carriage and Private Hire Licensing Policy.

Mid Sussex District Council introduced a Taxi Licensing Policy on 1st October 2012. This was reviewed and readopted in May 2021.

Due to the revised Best Practice Guidance issued by the Department of Transport in November 2023, concerns surrounding the refusal and acceptance of electronic payments and the perceived lack of availability of Wheelchair Accessible Licensed Vehicles the policy has been reviewed and some processes have been updated and amended. The amendments are listed here as headings.

  1. Updating Points based enforcement system for points to remain for 36 months.
  2. Introduction of Disability Awareness training for Operators who are not licensed drivers
  3. Removal of roof signs from Private Hire vehicles
  4. Remove the requirement for vehicles to carry a fire extinguisher
  5. Measures to ensure drivers of Wheelchair Accessible vehicles have appropriate training in connection with the loading and unloading of disabled customers
  6. Introduction of card readers to all licensed vehicles
  7. Removal of cap on Hackney Carriage Vehicle licences with all new licenses issued to wheelchair accessible vehicles.

The amendments were reviewed by the Licensing Committee 29 July 2024.

The public consultation phase will run from the 5 August until the 29 September 2024.

Re: Consultation – Animal Welfare Policy

The Council’s existing Animal Welfare Policy came into effect on 1 February 2020. Good practice suggests that the Policy is reviewed at least every 5 years, and at other times when considered necessary, for example, to reflect significant changes in relevant legislation or guidance.

Since the Policy was approved there has been no legislative changes that affect the Policy. The guidance documents have been updated by DEFRA, but there have been no substantive changes to the legislation. Officers have reviewed the current policy to ensure it provides clear guidance to future applicants and consider it remains fit for purpose. Whilst there is no statutory requirement for a policy, it is considered good practice. The review period is five years, in line with similar policy review periods such as those under the Licensing Act 2003.

A final version will be written taking into account the results of the consultation exercise.

The policy has been specifically prepared to take account of the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018.

Any comments on the Policy should be received by the Licensing Team no later than 29 September 2024.

P24/54 APOLOGIES FOR ABSENCE. Apologies for absence were received from Cllr Bill Hatton. Absent without apology Cllr Angus Neil.

P24/55 DECLARATIONS OF INTEREST.  Cllr Kristian Berggreen declared a non-pecuniary interest in item 9 of the agenda – MSDC Licensing Consultations.

P24/56 ELECTION OF CHAIR AND VICE CHAIR.

ELECTION OF CHAIR. Cllr Lesley Cruickshank-Robb proposed that Cllr Kristian Berggreen was elected as Chair of the Planning Committee for 2024/25 and this was seconded by Cllr Robert Brewer. All Members voted in favour.

P24/56.1 It was RESOLVED that Cllr Kristian Berggreen was elected as Chair of the Planning Committee for 2024/25.

ELECTION OF VICE CHAIR Cllr Kristian Berggreen proposed that Cllr Robert Brewer was elected as Vice Chair of the Planning Committee and this was seconded by Cllr Lesley Cruickshank-Robb. All Members voted in favour.

P24/57 MINUTES. It was RESOLVED that the minutes of the Planning Committee meeting held on 5 August 2024 be signed by the Chair as a true and accurate record of the meeting.

The applicant may wish to note that alterations that are built to a Nearly Zero Energy standard, are unlikely to need further retrofitting to minimise the carbon emissions that the nation is required to reduce to zero by 2050.  As retrofitting an existing home to be highly energy efficient is more complex than doing so for a new building, applicants may wish to look at the ‘EnerPHit’ standard that the Government is understood to be considering as the applicable “Nearly Zero Energy’ standard in this context, or at the Architypes published by the London Energy Transformation Initiative for u-values for your extension walls, windows etc. and for ventilation and overheating prevention standards to be achieved.

The Council also continues to support the recommendation made by the MSDC Environmental Protection Officer that the ‘restrictions on the evening timings for use of the courts, as offered by the applicant, are enshrined in a condition included in the decision notice.’

SDNP/24/02211/FUL Land North of Holm Oak Brighton Road Hassocks West Sussex Erection of residential log cabin. Response: RECOMMEND REFUSAL. This application is considered to be contrary to several Local Plan and Neighbourhood Plan policies including SD1: Sustainable development, SD4: Landscape Character, SD6 Safeguarding Views and SD9: Biodiversity and Geodiversity of the South Downs Local Plan and Policy 3: Green Infrastructure, Policy 6: Development Proposals Affecting the South Downs National Park and Policy 9: Character and Design of the Hassocks Neighbourhood Plan.

The strip of land in question borders a significant and very well used Public Right of Way which joins Hassocks to the historic Conservation Area of Clayton. Walkers have a tree lined view across to the west as they walk along the path adjacent to the site; as can be seen in photo 6 of the application. The installation of a large cabin as proposed, would impact negatively on this view and the sense of space and rural setting it offers.   Therefore affecting the visual tranquillity and character of the landscape.

Furthermore this is a small rural area within the South Downs National Park which provides valuable, primarily undisturbed, wildlife habitats and should therefore be protected as such.  Whilst the Parish Council welcomes any efforts to conserve and restore existing wildlife habitats on the land, it considers that a proposal to turn the site into a residential location would be detrimental to such efforts.  The installation of a permanent home would result in ongoing disturbance to the setting through additional lighting, more frequent vehicular movements and a general more regular onsite presence.

There is no justifiable need for development to be allowed on this site and it is considered that permitting a residential cabin to be erected would cause significant harm to this setting.
